David Dunn practices in all areas of commercial and corporate litigation, with extensive experience in the areas of labor and employment law, intellectual property, and banking and financial matters. He appears regularly in federal and state trial and appellate courts, as well as in alternative forums such as commercial arbitration.
David has prosecuted and defended copyright and trademark infringement actions involving written works, motion pictures, and television programs. In the course of resolving intellectual property disputes, he has negotiated various licensing and distribution agreements relating to the exploitation of films and television programming and the use of trademarks.
In the employment law area, David has extensive experience in matters involving personal employment agreements for executives and other highly skilled employees, representing both individuals and employers. He has regularly represented employers in state and federal employment discrimination matters for more than 15 years. He provides counseling and advice on various employment related issues, including protection of trade secrets and restrictive covenants. As an adjunct to his employment practice, David has been involved in negotiations and litigation involving the dissolution of law firm partnerships and other privately held businesses.
In the banking and finance areas, David has extensive experience representing financial institutions. His matters include lender liability claims, letter of credit disputes, and unfair trade practice claims. He has represented financial institutions in connection with a variety of disputes relating to acquisitions of other institutions or properties, investments, public offerings, and customer disputes.
David's practice also includes complex litigation involving commercial contracts of various types as well as antitrust, securities, and tax disputes. He has acted as special investigatory counsel for several businesses. In two instances, those investigations related to issues arising from bankruptcy cases involving large companies.
From 1980 to 1983, David was Chief Counsel to a member of the National Labor Relations Board. Earlier, he served as a member of the professional staff and then as a consultant to the U.S. Senate Committee on Labor and Human Resources.
David is an avid writer and lecturer. From 1984 to 1997, he was an assistant editor of The Developing Labor Law and annual supplements to that work, which is written by the Committee on the Development of Law under the National Labor Relations Act, American Bar Association and published by BNA Books. David is the author of several articles and monographs, including "Unreported Decisions in the United States Courts of Appeals," 62 Cornell L. Rev. 128 (1977). He lectures on labor law, civil procedure, privacy, intellectual property rights protection, and other topics to law school and professional groups.
