Eric Lobenfeld has more than 30 years of experience litigating cases involving patent, trademark, copyright, antitrust, unfair competition, securities, and complex commercial issues. He has first-chaired jury and non-jury trials in state and federal courts throughout the United States, conducted arbitrations, and argued in numerous U.S. state and federal appellate courts. In September 2003, he led the successful trial team that represented Symbol Technologies in two jury trials involving patents on wireless networking technology. The National Law Journal included this case in its list of the top 100 verdicts in 2003, and ranked it the #7 intellectual property verdict.
Eric represents companies in a wide variety of industries, including computer hardware and software, pharmaceuticals, medical devices, bar code scanning, wireless local area networks, electrical components, television broadcasting, motion pictures, publishing, baby toys, and financial services.
Eric is a regular panelist in the Practicing Law Institute's annual two-day patent litigation program, where he gives a demonstration of a closing argument in a patent jury trial.
Prior to joining Hogan & Hartson, Eric was a partner at several other major law firms and also served as Vice President/Chief Litigation Counsel for Reliance Group Holdings.
Representative Experience
Represented Symbol Technologies, Inc. in patent litigation against Proxim, Inc. involving two of Symbol’s wireless local area network patents covering a basic feature of the 802.11 WiFi standard. Obtained a jury verdict in Symbol’s favor, including $22 million in damages.
Represented Rockwell Automation in copyright and trade secret litigation against Goss Graphic Systems involving software for industrial printing presses.
Represented Disney and its subsidiary, Buena Vista Home Video, in copyright and Lanham Act litigation brought by the publisher of Igor Stravinsky’s “The Rite of Spring” arising from Disney’s release of the animated motion picture “Fantasia” in video format. Won seminal decision in the Second Circuit on the scope of “old” licenses in the context of new uses. Obtained summary judgment for Disney in similar litigation brought by the Executor of Leopold Stokowski’s estate.*
Represented ABC, Inc. and the Hearst Corporation in copyright litigation involving photographs and film clips of John F. Kennedy, Jr.*
Represented Symbol Technologies in securities litigation alleging violations of Securities and Exchange Commission proxy rules in connection with directors’ stock option plans. Won dismissal of the complaint and affirmance in the Second Circuit.*
Represented ESPN in litigation against Major League Baseball concerning contracts for television rights to telecast both baseball and National Football League games.*
