Kevin J. Lipson
Partner, Washington, D.C.

Kevin Lipson has participated in all phases of energy practice, including representation of clients before the Federal Energy Regulatory Commission (FERC) and other regulatory authorities, and the U.S. Court of Appeals. Kevin represents a major interstate natural gas pipeline, several of its affiliated companies, one of the nation's largest users of natural gas for the generation of electricity, a large LDC in Chicago, and a major Midwest electric generator. In that capacity, he has engaged in all stages of FERC rate and certificate proceedings, appellate review, and transactional matters. Kevin has been involved in the litigation and settlement of issues such as service restructuring, affiliate codes of conduct, market power issues, the California energy crisis, access to facilities, rate design, income taxes and related issues, cost of service, and other issues that arise in the context of electric and natural gas regulation. His experience has included settlement negotiations, certificate proceedings, FERC rulemaking and ratemaking proceedings at all stages, appellate review of FERC decisions, and contract negotiation, drafting, and interpretation. Kevin is also bank counsel to a major bank in providing financing of retail energy services. 

Prior to joining the firm, he was a partner in a major energy law firm in Washington, D.C. He is a member of the Energy Bar Association and the American Bar Association.

At Washington University, Kevin served on the editorial board of the Law Review.

REPRESENTATIVE EXPERIENCE
Kevin was lead FERC trial counsel in the seminal El Paso litigation that resulted in a $1.7 billion settlement arising from allegations of the exercise of market power in California natural gas markets and its impact on electricity prices. Kevin has also handled several very sensitive matters before the FERC Market Oversight and Enforcement Division.
