Michael Martensen’s practice covers a broad range of intellectual property matters, including patent prosecution, patent litigation, patent portfolio management, IP protection in government contracts, client counseling in areas of infringement and validity of patents, and freedom to operate and product clearance investigations. He also helps his clients to maximize and preserve the value of their intellectual property when dealing with the government. In addition, Michael counsels companies on protecting and commercializing intellectual property developed under government funding, and also assists them in securing their rights when their technology is or may be of interest to government entities.
As a registered patent attorney, Michael prosecutes patents in the technical fields of computer science, software, Internet-related technologies, semiconductor devices and materials, encryption, fluid dynamics, and the mechanical arts, focusing on aerospace-related inventions.
In the area of IP licensing and transactions, Michael has conducted numerous patent claim comparisons stemming from both defensive and offensive positions. From these analyses, Michael has helped clients foster a position for cross licensing or, when necessary, secure their intellectual property rights via litigation.
Prior to practicing law, Michael was a fighter pilot and mission commander in the U.S. Air Force (USAF), flying F-15s for more than 15 years. During his tenure in the Air Force, Michael traveled extensively and operated in several theaters, including the Middle East during and subsequent to the first Iraq war. In addition to his operational experiences, Michael was also a USAF program manager charged with operational testing of advanced systems and weapons related to the F-15 and other tactical systems. Michael is currently a retired officer in the USAF possessing the rank of Lt. Colonel. Michael is also an adjunct professor at the University of Colorado, Colorado Springs, providing graduate level instruction to engineers and scientist, regarding intellectual property and its relationship in the commercial marketplace.

Represented Sun Microsystems in patent and antitrust litigation against the leading software company resulting in a multibillion dollar settlement in favor of Sun.
Represented a leading provider of policy-based change and configuration management software in a patent litigation case against a leading systems management software company involving differential software distribution and content management across a distributed network.*
Represented the world's largest supplier of innovative flash memory data storage products in an International Trade Commission action involving flash memory against another leading communications equipment manufacturer.*
Represented the world’s fifth largest semiconductor company in gaining patent protection for key technology areas and in defending against patent infringement assertions by a patent troll.
